Employers Federal COBRA law applies to employers with more than 20 employees.

HIPAA applies to virtually all employers (except small, self-funded groups). Employers that are subject to COBRA and HIPAA must maintain, on site, a COBRA Procedures Manual and HIPAA Privacy Manual.

A leading COBRA administrator estimates that as many as 95% of all employers are out of compliance with COBRA. Most are small employers (those with less than 100 employees). The compliance burden for these small employers is relatively small. A company with 50 employees and moderate turnover may experience less than 10 COBRA events per year.

The reason that most employers are out of compliance is failure to establish a relationship with trusted provider of up-to-date materials. CobraAid was formed to do just that. Provide a cost-effective, efficient way to stay in compliance. Our Employer Compliance Program gives you the tools you need to stay in compliance with COBRA's regulations and HIPAA’s Privacy rules.
